Welcome to EarnUpSkill.com ("EarnUpSkill", "we", "us", or "our"). These Terms & Conditions ("Terms") govern your access to and use of our e-learning platform, affiliate marketing programs, and related services (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Platform.

EarnUpSkill provides an innovative platform where users can Earn, Learn, and have Fun through our digital courses, affiliate marketing opportunities, and engaging tasks/games.

Account Creation

To access certain features of the Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Be responsible for all activities that occur under your account
• Immediately notify us of any unauthorized use of your account

Account Types

Platform Services

EarnUpSkill provides:

• Comprehensive e-learning courses (Digital Marketing, Computer Skills, etc.)
• Affiliate marketing opportunities to earn commissions
• Engaging tasks and games that reward participation
• Points system that can be redeemed for courses or cash
• Community features and support

Mandatory Courses

Certain courses are mandatory for platform participation:

• Digital Marketing Fundamentals
• Essential Computer Skills
• Platform Orientation Course
• Other courses as specified in your account

These courses must be completed (using Points or payment) before full platform access is granted.

Payment Processing

EarnUpSkill provides payment processing services through third-party providers. All payments must be processed through the Platform unless otherwise agreed in writing.

Fees

Our fee structure is as follows:

Affiliate Commissions

Our affiliate program pays commissions as follows:

• 20% commission on first course purchase by referred users
• 10% recurring commission on subsequent purchases
• Minimum Rs. 500 balance required for affiliate payout
• Commissions paid within 15 days of month-end

Content Ownership

Users retain ownership of all content they submit to the Platform ("User Content"), except for course materials which remain proprietary to EarnUpSkill or its licensors.

Course Materials

All course materials provided through the Platform are for personal use only. You may not reproduce, distribute, or create derivative works without explicit permission.

Content Restrictions

You agree not to post User Content that:

• Violates any law or third-party rights
• Is fraudulent, false, or misleading
• Contains viruses or malicious code
• Is defamatory, obscene, or offensive
• Constitutes unsolicited advertising

All Users agree to:

• Complete mandatory courses before accessing full platform features
• Comply with all applicable laws and regulations
• Provide accurate information and maintain account security
• Not engage in fraudulent or deceptive activities
• Not share account access or course materials
• Not interfere with Platform operations or other Users

Learner Responsibilities

Learners additionally agree to:

• Complete courses with integrity (no cheating)
• Not automate task completion
• Not exploit referral systems unfairly
• Maintain respectful community interactions

Affiliate Responsibilities

Affiliates additionally agree to:

• Accurately represent our courses and platform
• Not use spam or deceptive marketing practices
• Comply with all applicable marketing laws
• Not make false earnings claims

By Users

You may terminate your account at any time by following the account closure process in your account settings. Outstanding balances below the minimum withdrawal amount will be forfeited upon account closure.

By EarnUpSkill

We may suspend or terminate your account at our discretion if we believe you have violated these Terms or applicable laws. We will typically provide notice and opportunity to cure when appropriate.

Effect of Termination

Upon termination:

• Your right to use the Platform immediately ceases
• Any pending withdrawals may be canceled
• We may retain certain information as required by law
• Provisions of these Terms that should survive will remain in effect

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, EARNUPSKILL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Specific Disclaimers

• We do not guarantee specific earnings from affiliate programs or tasks
• We do not guarantee uninterrupted or error-free service
• Course completion does not imply employment or income guarantees
• Individual results may vary based on effort and other factors

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARNUPSKILL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR USE OR INABILITY TO USE THE PLATFORM
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
• YOUR RELIANCE ON INFORMATION OR EARNINGS POTENTIAL PRESENTED ON THE PLATFORM

Total Liability

IN NO EVENT SHALL EARNUPSKILL'S AGGREGATE LIABILITY EXCEED THE GREATER OF Rs. 1000 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

Dispute Resolution Process

If you have a dispute with EarnUpSkill:

1. Submit a detailed dispute request through our support system
2. Provide all relevant documentation
3. We will review and may request additional information
4. We will make a determination within 30 days
5. Our decision is final regarding Platform-related matters

Legal Disputes

Any legal disputes with EarnUpSkill shall be resolved as follows:

• Governing Law: Indian law
• Jurisdiction: Courts in Hojai, Assam
• Arbitration: Disputes may be resolved through binding arbitration under Indian Arbitration Act
• Class Action Waiver: All claims must be brought individually, not as class actions

We may modify these Terms at any time. We will provide notice of material changes through the Platform or via email. Your continued use after changes constitutes acceptance.

Earning Points

EarnUpSkill offers a points system where Users can earn points ("Points") through:

• Referring new Users to the Platform (Referral Points)
• Successfully completing tasks or projects (Task Points)
• Participating in Platform activities and promotions

Points Usage

Points may be used for the following purposes:

• Course Enrollment: Points can be used to join courses on the Platform. If a course has not been purchased, Points must be used for enrollment.
• Withdrawal: If a course has already been purchased, accumulated Points may be eligible for withdrawal as cash, subject to the following conditions:
  • Minimum withdrawal threshold must be met (1000 Points = Rs. 1000)
  • User account must be in good standing
  • All verification requirements must be completed
  • Withdrawal requests may take 7-14 business days to process
• Platform Benefits: Points may be redeemed for Platform benefits such as course discounts or premium features
